On November 6,2021, the symposium on “Mission and Responsibility · Ethics of Professional Lawyer in the New Era” hosted by Shanghai University Law School and led by Sunhold and Dongdu Law Firm was successfully held in SUnhold at 75F of Shanghai Center.

The opening ceremony was chaired by Professor Xueguo Wen, from the School of Law of Shanghai University. Professor Xueguo Wen gave a brief introduction to the background, participants and agenda arrangement of this symposium. Yanhao Liu, Deputy Director of Shanghai Bureau of Justice, Professor Jianlong Yao, Director of Shanghai Academy of Social Sciences Institution of Law, and Tingfeng Tian, Director of Sunhold delivered a keynote speech.
Professor Xueguo Wen Hosted the Opening Ceremony
Deputy Director Yanhao Liu first introduced the macro status of the rule of law construction. From the national level, the " 14th Five-Year Plan " of China and the two implementation outlines of the rule of law society and the rule of law government have been issued, which clarifies the path and direction of the rule of law construction in China. From the Shanghai level, Shanghai lawyers have a strong visibility and competitiveness in China, but the overall legal services industry in Shanghai still has room for development. Deputy Director Yanhao Liu also interpreted the function transformation of the recently established Hongqiao Central Judicial District and Bureau of Justice.
Keynote Speech by Deputy Director Yanhao Liu
Professor Jianlong Yao leaded to the theme of his speech from the two provisions prohibiting malicious speculation by lawyers and prohibiting improper contacts between judges, prosecutors and lawyers, and put forward three ideas. The first is to put forward the view that “risks in prison, difficulties in lawyers”. He pointed out that the society regards lawyers ’ occupation as work outside the system, and thus does not use the methods and norms within the system to require lawyers. Therefore, it is necessary to recognize the urgency and necessity of figuring out methods which promote the transformation of lawyers outside the system, and to put forward suggestions to strengthen the party construction in the lawyer industry. Second, lawyer’s professional ethics is a problem of choice between bottom line and conflicts in interest, and the tendency to unilaterally magnify lawyer’s professional ethics should be prevented. Professor Yao believed that lawyers should have three bottom lines : political loyalty ( national feelings ) ; second, loyalty to customers, loyalties in both customer interests and lawyers’ own judgment and style; third, a social bottom line, the courage to assume social responsibility. Thirdly, he emphasized that the construction of lawyer ' s professional ethics should be strengthened, and professional stigma and guilty reasoning should be vigilant to prevent overcorrection. We should not only adhere to a phased view of the lawyer hype cases, but also adhere to a comprehensive view of the problem. We should not prejudiced the whole lawyer profession because of a few lawyers’ acts.
Keynote Speech by Professor Jianlong Yao
Director Tingfeng Tian first affirmed and supported the view that the over-commercialization of the lawyer industry should be addressed. He pointed out that with the rapid development of the lawyer industry, the negative problems caused by the commercialization of the industry were increasingly prominent and should be controlled. Secondly, from the perspective of the whole industry, Tian put forward whether there is overcorrection. Combining the practice of training and communication carried out by Sunhold, analyzing from two dimensions of incentive and constraint, he emphasized that the balance between incentive and constraint should be sought. Finally, Tian explained the unique professional advantages of lawyers in Shanghai.

The symposium also held free discussion. Finally ended in a relaxed and pleasant atmosphere. This seminar focused on the professional ethics of lawyers in the new era, analyzed and exchanged the current problems in the lawyer industry, and provided support for the sustainable and healthy development of the lawyer industry.
