Shi’s key practice areas are domestic and foreign-related commercial arbitration and litigation at courts of different levels in China. Shi is proficient in dealing with cases in both Chinese and English. As counsel, Shi has handled cases ranging from international sales of goods, commercial loans, technology licensing, judicial review of arbitration, and unfair competition. Prior to joining Sunhold, Shi used to work as a case manager at CIETAC and has functioned as case administrator or assistant to CIETAC senior arbitrator in dealing with hundreds of arbitration cases.

Before joining Sunhold, Shi was senior associate with GoldenGate and had previously served as a case manager at CIETAC.

· Represented a Dutch technology company in a CIETAC administrated arbitration over a joint venture dispute and resulting in all the opposing party's arbitration claims dismissed by the arbitral tribunal. As one of a series of disputes arising from the investment agreement and technology licensing agreement between the parties, the handling of this case required a coordination of parallel proceedings in different jurisdictions and issues in the arbitration, among others, included the application of the principle of res judicata in international arbitration.

· Represented a globally renowned bottling company in an arbitration case concerning equipment quality dispute before CIETAC, with the case conducted in English and governed by CISG, involving a disputed amount exceeding CNY 100 million, and despite the unfavorable circumstance that the equipment was never made to achieve commercial production, resulting in all of the client's arbitration claims supported by the arbitral tribunal.

 

· Represented a Swiss company which run a globally renowned writing instrument brand in a distribute contract dispute against its Chinese distributor in the first and second instance litigation before the Beijing Fourth Intermediate People's Court and the Beijing Higher People's Court, resulting in all the opposing partys claims dismissed by the court. Key issues included whether there had been an abuse of authorization by the distributor and the validity of the clients termination of its distribute contract with the Chinese distributor.

 

· Handled a lawsuit between a US medical products company and its Chinese medical supplier over quality disputes before the Beijing Fourth Intermediate People's Court, and the applicable law was CISG, resulting in all of the client's arbitration claims supported by the court. This case was recognized by the PRC Supreme People’s Court as model cases respectively for application of international treaties in foreign-related disputes in 2023.

 

· Represented a German manufacturing company in an international sale of machinery and equipment dispute administered by CIETAC in Chinese and governed by Chinese law, and assisted the client to reach settlement to the client's satisfaction.

 

· Represented an international financial organization, as the lender and pledgee, in initiating a special procedure for the realization of security interests and handled the enforcement procedures following the former procedure, against a domestic company, which acted as the borrower and pledgor, in a primary court in Jiangsu.

 

· Handled a series of disputes between the client, which is a renowned advertising company and its service provider, originating from a service contract and strategically evolving into disputes involving copyright infringement and defamation, resulting in all claims by the opposing party dismissed by the Court.

 

· Represented a Chinese company in dealing with a series of labor disputes arising from work injury before the larbor arbitration court and the Chaoyang Primary People's Court in Beijing.
